Ventura County Family Suing For Wrongful Death

A trial has started this week for a case involving an eighteen year old girl dying in a car accident. The parents of Candice Lopaty, Roy and Donna, are
suing Ventura County because they say the road where their daughter's car launched off the road was dangerous and repeatedly overlooked.
"She was 18 years old on Christmas Day 2004 when she lost her life," said the Lopatys' lawyer, Douglas D. Shaffer of Santa Monica.
The Lopaty's say that their daughter was only traveling 45 miles per hour and that there weren't any guard rails or other safety precautions taken on that section of the road even though there have been over 17 accidents on that stretch alone in the last 8 years.
However Bruce Fink, Attorney for the county, is arguing that not only were proper precautions taken, including guardrails and reflectors, but also that Candice was driving at an excessive speed.
"There are millions of cars that go through that roadway, uneventfully," Finck told jurors.
