Ventura Man, Convicted of Assault, Wants New Trial

36 year old Richard Boos was convicted in January of raping a sleeping women after a party in April of 2004. The 19 year old women was alseep in the bedroom of a friend's house and had been drinking and taken Vicodin before she fell asleep. He was found guilty of two felony counts of rape of an unconscious person and anal penetration of an unconscious person with a foreign object.
Richard was also charged with two other felonies which were dropped by the district attorney after jurors were deadlocked.
His defense attorney has now filed for a new trial although sentencing has not yet occurred. The prosecution argued that the motion is untimely although the law does allow for a new trial motion to be filed anytime before during or after a trial. The new sentencing is set for Feburary 19th.
The prosecution has also stated that Boos is a registered sex offender for a crime he committed against a women in 1998, a charge which he says is also false.
