A previous blog discussed the case of fourteen year old Brandon McKierney shot and killed a classmate, Larry King. At the time the prosecution was debating weather or not to upgrade the murder charges with a hate crime enhancement because of King's sexual orientation.
Recently the courts have decided to upgrade the charges, therefore McKierney now faces up to 53 years in prison. The crime occurred on school grounds and was allegedly fueled by a mounting irritation turned violent outburst between the boys.
McKierney's defense attorney was concerned about an impartial jury due to the intense media coverage in their area, however instead of moving the proceedings the judge has decided to bring jurors in from the Santa Barbara area.
