In the extremely early morning of November first 2009, a car driven by an intoxicated Hector J. Ortiz struck another car head on killing 19 year old Taylor Moss.
Ortiz entered a not guilty plea this past week at his arraignment. His attorney is arguing that although his 0.08 blood alcohol level means that he was indeed intoxicated, his actions are not such that he should be charged with murder.

However, the prosecuting attorneys, who the judge had sided with, say that the defendant ignored the fact that he was driving the wrong way down the highway and consciously put others in extreme danger.
His trial is set to start on October first and Ortiz will indeed face murder charges.
