Assault and Battery San Bernardino

A pair of San Bernardino County siblings was arrested on assault and battery charges following the conviction of their brother on second-degree murder charges. Rose Bernal, 25, and her 16-year-old brother were arrested in a courtroom and charged with assault on a public official and battery on a police officer.

At the time the incident began, a jury in the courtroom had just found Rafael Quiroz guilty of second-degree murder. Bernal approached Deputy District Attorney Mike Dowd and began shouting at him. Deputies approached Bernal and she appeared to resist arrest. Deputies cleared the courtroom, but moments later came into the hallway and arrested the juvenile for his participation in the same incident. Bernal is being held at the West Valley Detention Center in Rancho Cucamonga on a $500,000 bond. The name, location and custody status of the juvenile were not released.

Quiroz was on trial for the murder of his married girlfriend's husband in 2006. He could have been convicted of first-degree murder and would have been sentenced to 50 years to life in prison for murder and using a firearm. Instead, he will face a sentence of 15 years to life in prison. His girlfriend, Ingrid Esteves of San Bernardino was convicted last week of first-degree murder in the death of her husband and will face a sentence of 25 years to life in prison.
