Medical Marijuana Case Delayed
A Westlake Village medical marijuana dispensary will be in court this week to defend itself against charges of violating local zoning ordinances. Amazing Healing Supply which opened at the end of May was ordered to close this month after the city alleged that the business was operating illegally.
Amazing Healing Supply says it has asked the judge to issue a temporary restraining order against the city that will enable it to restart its operation. The company says that it qualifies as a medical marijuana collective under the rules of Proposition 215 which was approved in 1996. The city counters that its complaint against the business is not based on the legality of medical marijuana, but rather than the business has not complied with local zoning ordinances.
Medical marijuana still raises a number of legal challenges, even though the US Supreme Court has refused to hear challenges to the validity of the law. Legally authorized medical marijuana users still face criminal prosecution and other sanctions for attempting to exercise their legal rights.
