Sailors Face Trial In Death Of Former Seaman
The former wife of a Navy seaman, herself a construction mechanic in the Navy, and another sailor are being tried for the murder of the woman's ex-husband. Ventura County prosecutors allege that Rebecca Braswell and Matthew Toerner, along with two other sailors, conspired to kill former Navy seaman John Marmo, Jr., as part of a plan to end a custody battle over Braswell and Marmo's daughter.
The couple met while they were stationed together in Italy and married there, shortly before the birth of their daughter. The marriage crumbled and Braswell and Marmo argued over custody arrangements for the girl. Prosecutors allege that Braswell and another sailor, Shannon Butler, made threats against Marmo and Braswell said she would rather kill her former husband than lose custody of their daughter. Forensic analysis of Braswell's computer also showed evidence that it was used to research information on the Internet about bomb-making and blowing up cars.
Prosecutors say that Butler, who will be tried later this year, enlisted the help of two other sailors, who agreed to kill Marmo. After two failed attempts to destroy Marmo's vehicle, prosecutors say that Toerner and Seth Hardy rented an SUV and ambushed Marmo as he left his home for work one morning. Marmo died at the scene of the attack, after suffering three gunshot wounds. Hardy will be tried separately on attempted murder charges for his role in the failed attempts to blow up Marmo's truck.
