Ventura Student Faces Murder Charges
A 15-year-old Ventura boy will be tried for the murder of a classmate in Oxnard. Brandon McInerney will be tried as an adult in the shooting death of a gay classmate in February 2008. Ventura Superior Court Judge Ken Riley said that McInerney's statements to other students, which included direct threats against the victim, were compelling enough to warrant trial as an adult. McInerney will also face hate crimes charges.
McInerney ties to a neo-Nazi supporter were also cited in the judge's decision. At the hearing last Wednesday, Riley also added a special circumstance of lying in wait for Larry King, 15. King was shot twice in the head during a computer class. King was openly gay and wore makeup, earrings and high heels to school. Ventura County prosecutors have offered a 25-year plea deal to McInerney's attorneys but they have not yet accepted it. Without the plea bargain, McInerney faces more than 53 years in prison.
McInerney's attorneys say they will attempt to have the case moved back to the juvenile court on appeal, saying that prosecutors had abused their discretion by charging McInerney as an adult.
