The five-year drug sentence of a Los Angeles County man was overturned by the Los Angeles Superior Court after county prosecutors admitted that the police report submitted by an officer from the Torrance Police Department had been falsified. A defense attorney working for Michael Baker noted significant discrepancies between that document and an account of the arrest given by a federal agent. Court documents also showed that Los Angeles Police Department documents also contained the fictitious arrest account.
According to the Torrance Police Department, Mr. Baker was arrested because he fit the description of a suspect wanted in connection with the robbery of a 7-Eleven store in Torrance that happened earlier on the day that Mr. Baker was arrested. Police said that the also found PCP in Baker's car at the time of his arrest.
The account given by the federal agent reported that the Torrance Police Department used one of the federal agent's confidential informants to arrange a drug deal with Baker in an effort to set Baker up for arrest on drug charges.
A Deputy District Attorney told Judge Craig Mitchell that the drug charges against Baker should be thrown out as the results of misstatements made in the official police report. The misstatements were made, according to Scott Goodwin, in an effort to protect the federal agent's confidential informant.
Baker's legal troubles are far from over, however. He still faces trial on a federal grand jury indictment that accuses him of working with the Grape Street Crips to manufacture and sell PCP nationally. The loss of the state's case, however, significantly reduces the amount of jail time Baker would face if convicted.
